SAVANNAH, Ga. -- Environmental regulators for South Carolina have denied a
permit sought by the Army Corps of Engineers for deepening the river
channel to Savannah's seaport, placing an obstacle in the way of one of
Georgia's economic priorities.

The Georgia Ports Authority wants to deepen 32 miles of the Savannah River
by 6 feet in order to give supersize cargo ships better access to the
Savannah port. The corps is expected to release its final plan for the
harbor expansion this fall.

The South Carolina Department of Health and Environmental Control filed
documents late Friday saying the harbor deepening would cause unacceptable
harm to the river, which forms a shared boundary between the two states.

The agency said the project would harm more than 1,200 acres of marsh by
altering the salinity of the river, and make it harder for fish to thrive
by reducing oxygen levels in the water.

"The proposed activity could result in significant degradation to the
aquatic ecosystem or remove existing and classified uses of the Savannah
River," said the documents filed by South Carolina regulators.

The corps has proposed plans for mitigating the environmental drawbacks
cited by South Carolina, but the state's regulators said they are not
satisfied with the solutions.

Georgia's Environmental Protection Division, on the other hand, approved
its water quality permit for the same project earlier this year, saying its
regulators felt the Corps had addressed their concerns.

"The difference of opinions between the Georgia Environmental Protection
Division and this action by the S.C. DHEC is disturbing," Curtis Foltz,
Georgia's top ports executive, said in a statement.

Foltz said he "firmly believes" the corps' final plans for deepening the
harbor will deal with all environmental concerns surrounding the project.

Permits were sought from Georgia and South Carolina because the federal
Clean Water Act gives states some leverage to determine if construction
projects on their waterways will adversely affect state water quality
standards.

It is unclear how much South Carolina's permit denial will affect plans to
deepen the river route to the Savannah port, the fourth busiest container
port in the United States.

The next step would be for the Army Corps to appeal the permit denial to
South Carolina officials by mid-October.

Georgia port officials said the project needs to be completed as soon as
possible, with more giant cargo ships expected to call on East Coast ports
after a major expansion of the Panama Canal is completed in 2014.

The rival port of Charleston is one of Savannah's closest competitors.

Port officials are hoping the corps can get final approval for the harbor
expansion by mid-2012 and that construction can wrap up in 2016.

While Georgia officials have focused on the economic imperative of
deepening the Savannah River, environmentalists are siding with South
Carolina regulators in saying the project could do serious harm to a major
waterway.

"The deepening proposal raises serious concerns for the health of the
Savannah River and the people and wildlife that depend on it," said Chris
DeScherer, an attorney for the Southern Environmental Law Center.

"The proposed deepening would further compromise the Savannah River's
chronic water quality problems and threaten surface and groundwater
supplies for local communities," he said.
