Budget board OKs $16.8M sale to Charleston-based developer Gramling

Five years on the market and one previously failed sale later, the State
Ports Authority on Wednesday received the authorization it needed to
unload 50 acres it owns in Port Royal.

The state Budget and Control Board approved the land sale to Charleston-
based developer Ben Gramling for $16.8 million. The Beaufort County deal
passed in a 3-2 vote after considerable discussion.

An agreement is reportedly near for the sale of the SPA's Port Royal
terminal.

Gov. Mark Sanford and Richard Eckstrom, the state's comptroller general,
voted against the deal.

Gramling's bid came in nearly $10 million below a previous offer, a deal
that unraveled more than two years ago as the real estate market soured.
But his offer still hovered above the appraised value, reduced to between
$15.6 million and $16.3 million in late 2009.

Reached after the vote, Gramling said he plans to work with the Town of
Port Royal to develop a plan that includes public green space and also
low-density, single-family homes that fit in with the character of the
area.

"We're not looking to do something that's separate from the town," said
Gramling, who is best known locally as the developer of Cane Bay
Plantation in Berkeley County. "What were looking to do is create an
extension of the Town of Port Royal."

He declined to give a time frame for moving forward on the project, and
the sale still must close before becoming official.

The General Assembly ordered the Port of Port Royal closed in 2004, and
the SPA put the waterfront land up for sale in 2005. The deal, as
approved by the Budget and Control Board, splits the property into two
tracts: one primarily marsh and one primarily land.

The second half of the $16.75 million sale would close about three years
after the first phase. That means that infrastructure, such as roads,
would factor into the first phase of development and benefit the entire
property.

Most of proceeds will go into SPA coffers.

The governor suggested Wednesday that the land split made the
deal "materially different" from the original terms and that other
developers should have 30 days to bid under those conditions.

"We owe it to the rest of the development community, from the standpoint
of equity, to offer them the same deal," Sanford said.

Neil Robinson, an attorney representing the SPA in the deal, suggested
that the agency and the town cannot afford to lose an interested buyer.

"That's not the way real estate works, governor. I'm sorry," Robinson
said.

To which Sanford replied: "This is not the way the public process works."

Sanford called into question whether Robinson should represent the SPA in
a deal with Gramling when Robinson's firm has represented Gramling
Brothers in its Cane Bay project.

Sen. Larry Grooms, a Bonneau Republican, pointed out before the vote that
the General Assembly wrote into law last year that the SPA must sell the
Port Royal property. As chairman of the port oversight commission, Grooms
added that the land's value has fallen and that not jumping on an
opportunity to sell would prove a disservice to the public.

Grooms noted that talks in Columbia about closing and selling the port
began in 2002. "It's been going on eight years," he said. "It needs to be
sold."
