COLUMBIA — When the state Senate returns to work Tuesday, legislation will be waiting on their desks that changes governance at the State Ports Authority and adds a controversial rail access provision that's drawn the ire of North Charleston Mayor Keith Summey.
Even with only three legislative days left in regular session, there is little to no chance lawmakers will adjourn for the year without passing a version of the bill. Legislative leaders from the Charleston area are pushing for the overhaul, including Rep. Jim Merrill, R-Daniel Island, and Sen. Larry Grooms, R-Bonneau.
The legislation was prompted when the port's largest customer threatened to pull out and chief executive officer Bernie Groseclose abruptly resigned.
The House amended the Senate bill to increase education and experience standards for future board members, above the level of qualifications set by the Senate. The bill also now calls for board members to be appointed from Congressional districts and seats representatives from the state Commerce and Transportation departments on the board.
Merrill said the House also amended the bill to call for the timely sale of SPA property on Daniel Island, which could help pay for improvements to North Charleston such as the construction of overpasses to ease traffic burdens.
The version senators will consider also contains a provision that transfers a rail line on the former Charleston Naval Base from Charleston Naval Complex Redevelopment Authority to S.C. Public Railway. A similar provision was inserted in the state budget, which is now awaiting consideration for approval by Gov. Mark Sanford.
Summey has planned a rally at 7 p.m. Tuesday in Park Circle to protest the rail transfer provision. He is concerned with quality of life issues for his residents

OFFSHORE WATERS FORECAST
The National Weather Service is warning people to stay out of the ocean today due to a high risk of rip currents along the coast between Charleston and Beaufort.
Strong winds and building seas will make conditions dangerous in the surf zone throughout the day, forecasters warn. The risk of high surf and shallow coastal flooding is expected to increase throughout the week.
Forecasters also are encouraging boaters to stay out of Lake Moultrie in Berkeley County through Wednesday to avoid strong winds and large waves that could capsize boats. Northeast winds of 15 to 20 knots are expected today with gusts up to 25 knots.
The National Weather Service also urges drivers along the coast to use caution when driving over bridges and overpasses because of strong winds.
