<span-size:12.0pt;font-family:"Times New Roman","serif"">The former Port of Port Royal breakbulk cargo terminal has been closed for about a decade.

<span-size:12.0pt;font-family:"Times New Roman","serif"">BEAUFORT - A group of local businesspeople is suing the State Ports Authority, alleging the agency has mismanaged the sale of its former Port Royal marine terminal.

<span-size:12.0pt;font-family:"Times New Roman","serif"">The Beaufort Gazette reported that the 317-acre property that was once the site of a small breakbulk port has been vacant for a decade. Three attempts to sell it since 2006 have fallen through.

<span-size:12.0pt;font-family:"Times New Roman","serif"">The lawsuit alleges Beaufort County and the town of Port Royal have lost more than $7 million in property taxes while the land remains in state hands. The lawsuit also says the failure to sell the property has hurt the town's economy.

<span-size:12.0pt;font-family:"Times New Roman","serif"">SPA spokeswoman Erin Dhand says the claim has no merit. She says the matter has been referred to attorneys, and the agency will not comment further on the lawsuit.

<span-size:12.0pt;font-family:"Times New Roman","serif"">The suit was filed last week by Nancy Vista, who owns a clothing and gift store; Elizabeth Jenkins, who ran a cooking school; and developer Dick Stewart.

<span-size:12.0pt;font-family:"Times New Roman","serif"">They allege the authority has mismanaged the sale and failed to follow what is called the "prudent-man rule." That's a concept in common law requiring that trustees, such as a state agency, manage their assets as a thrifty person would.

<span-size:12.0pt;font-family:"Times New Roman","serif"">The newspaper reported that Stewart is one of four bidders known to have made an offer for all or part of the property. He and representatives of two other groups say the SPA has withheld pertinent information, including the appraisal value.

<span-size:12.0pt;font-family:"Times New Roman","serif"">Stewart said he sued because he has been frustrated by his interactions with the authority and disheartened watching the business struggles of his friends, Vista and Jenkins.

<span-size:12.0pt;font-family:"Times New Roman","serif"">"The ports authority needs to sell this property and get the heck out of Port Royal," Stewart said.

<span-size:12.0pt;font-family:"Times New Roman","serif"">The SPA operated a port on the property starting in 1958. The site includes 52 developable acres and deep water on Battery Creek.

<span-size:12.0pt;font-family:"Times New Roman","serif"">The General Assembly previously ordered the Charleston-based maritime agency to sell the waterfront property a decade ago. The original deadline was the end of 2009.

<span-size:12.0pt;font-family:"Times New Roman","serif"">Earlier this year, Gov. Nikki Haley signed legislation that requires the SPA to find a buyer by July 1, 2015. Otherwise, the property will be put up for auction.
