Senate advances bill to strengthen SPA accountability

The Senate advanced a bill on Thursday that outlines the qualifications
needed to serve on the State Ports Authority board and that strips the
governor of his ability to remove board members at will.

The legislation, sponsored by Sen. Larry Grooms, R-Bonneau, now moves to
the House Judiciary Committee for consideration.

As a compromise, the portion of Grooms’ bill calling for the
establishment of an independent port oversight committee was deleted from
the bill. The S.C. Chamber of Commerce actively opposed creation of such
a committee because it would have included – in addition to a number of
representatives from across the maritime industry – one member from the
International Longshoremen’s Association.

“The advisory committee had mandated union influence, which our members
strongly opposed, as well as potential environmental influence,” the
chamber said in a statement. “If we restructure the ports authority
board, our members didn’t see the necessity of having an advisory board.”

The SPA did not take a position on the legislation, said spokesman Byron
Miller.

The crux of the legislation is the new oversight rules it establishes,
such as mandating that any executive compensation requires a public vote
of the board. It also would require the agency to set up a searchable
public database outlining all expenditures of more than $100.

As for board members, the legislation says they must have at least five
years experience in one or a combination of the following fields:
maritime shipping; labor related to maritime shipping; overland shipping
by truck, rail or both; international commerce; finance, economics or
statistics; accounting; engineering; law; or upper-level business
management.

Additionally, board terms would decrease from seven years to five, though
the governor can reappoint a member as many times as he wants.

If the legislation becomes law, the governor would no longer be able to
remove members at his discretion, except for specific reasons, including
malfeasance, incompetency, conflicts of interest, misconduct or
persistent neglect of duty in office.

Gov. Mark Sanford opposes the legislation, specifically because of this
change.

“For all the talk in the Senate about the importance of accountability at
the ports authority, it’s hard to imagine something doing more harm to
the responsiveness and transparency of that agency than this change,”
Sanford said in a statement. “It’s very interesting that the very same
people who make the argument that the ports authority needs a change of
direction are the same people who want so much to take away a governor’s
role in indeed making those changes.”

Sanford is in support of legislation proposed by Rep. Jim Merrill, R-
Charleston, that would get rid of the ports board entirely, and make the
port director a cabinet level position appointed by and reporting
directly to the governor.

The legislation also:

Mandates that the SPA seek approval from the Budget and Control Board
before selling any property, buildings, terminals or any other permanent
structures, excluding equipment.
Calls for creation of a nine-member committee to study the feasibility of
privatizing portions of the SPA’s operations. The committee would be
required to report its findings to the General Assembly and governor by
March 1, 2010, at which time it would dissolve.
Requires the Senate Transportation Committee and House Ways and Means
Committee to each conduct an oversight review of the authority and its
operations at least once every two years.
