Panel sends port bill to full Senate

COLUMBIA — The beleaguered State Ports Authority would change its focus
from profits to economic development as part of an effort to return the
Port of Charleston to a position as one of the top East Coast container
ports under a plan approved by a Senate panel Tuesday.

That's the way Senate Transportation Committee Chairman Larry Grooms
pitched the urgency of his bill to the committee, which voted 9-4 to send
it to the full Senate for consideration.

The bill would require the authority to develop a long-term strategic
plan aimed at building the state's economy, create an advisory board,
change the way the governing board is appointed and set new
qualifications for its members.

Grooms, R-Bonneau, said the changes would restore the international
shipping community's confidence in South Carolina ports because the bill
provides for better planning, oversight and accountability. Charleston
Sens. Glenn McConnell, a Republican, and Robert Ford, Democrat, co-
sponsored the bill.

The SPA has been under fire as it faces the loss of its biggest customer
and deals with blowback from handing out executive bonuses during the
worst economic downturn South Carolina has seen in decades. Many point to
the bonuses as evidence that the ports authority is putting profits
before economic development.

The SPA defended the bonuses as a common practice at ports across the
country.

Not all the committee members were sold on the plan.

Sen. Greg Ryberg, R-Aiken, said he has major problems with the bill
because of a provision taking away the governor's ability to remove
members of the authority board when he sees fit.

On the "plan to bring significant reform to the State Ports Authority,"

"You have to be honest, some of it is just dislike for the chief
executive officer of the state of South Carolina," Ryberg said. "I can't
be sold at this point in time that by rearranging the chairs on deck of
the State Ports Authority that we're making a positive move forward."

Gov. Mark Sanford's press secretary, Joel Sawyer, said outside of
stripping the executive branch of its ability to hold board members
accountable, the bill does not do anything that the Senate can't all
ready do.

"Whatever the issues are with the port, taking away the governor's
ability to fire board members doesn't fix anything and makes it
potentially worse," Sawyer said. He noted that the Senate now has say-so
over whom the governor appoints to the board and in the past rejected two
of Sanford's nominees.

The bill allows the nine members of the board to serve seven-year terms.
They could be ousted only for specific reasons, such as poor attendance
and failure to perform duties. Grooms said this would give the board
stability and protection from political whims.

Sanford favors a plan by Rep. Jim Merrill, R-Daniel Island, that would
give the governor power to appoint the ports chief executive officer, a
position that became vacant when Bernard S. Groseclose Jr. resigned last
month. Merrill's bill is up for review in a House committee.

Sen. Chip Campsen, R-Isle of Palms, was one of the four committee members
who voted against the bill. The others were Ryberg, Senate Majority
Leader Harvey Peeler of Gaffney and Sen. Lee Bright, R-Spartanburg.

Campsen said he disagrees with the provision that would take away the
governor's power to remove the board members. That authority has nothing
to do with the port's troubles, which are more a result of the worldwide
recession and decisions about port development, he said.
