Union Members Reject Maersk's Cost-cutting Request

Called to an emergency meeting this week, nearly 500 members from all three local maritime unions rejected a proposal to let their biggest customer, Maersk Line, switch to State Ports Authority workers, labor officials said Friday.
When asked Thursday night who among them would consent to such a move, not a single person rose, said Ken Riley, president of International Longshoremen's Association Local 1422.
"No one was standing," he said.
While the response was hardly surprising, the show of solidarity underscores the growing angst on the Charleston waterfront, including concerns about Maersk.
The Denmark-based steamship line has threatened to pull its vessels from the Port of Charleston if it cannot reach a cost-saving agreement with the SPA and the ILA. If this contract feud were a game of poker, Thursday night's union vote would equate to calling Maersk's bluff.
But reached Friday, company representatives held their cards close to the vest. They said Maersk had not received any correspondence from the ILA and could not comment.
When the dispute surfaced publicly in October, Maersk representatives said in a written statement that the company "cannot remain in Charleston if it means losing money, and therefore if a path which enables profitability cannot be found, we will have to depart."
The SPA has contended that its cheaper, non-union labor would save the company money.
ILA members have disputed that their work rates are higher than the state's.
The problem stems from the container carrier's request to get out of its current contract with the SPA.
Maersk signed the contract through 2010, in which the SPA agreed to buy more than $8 million in equipment and to commit terminal space and staff to the company. The world's largest shipping line, Maersk accounts for one-quarter of Charleston's total container volume.
But throughout this year it has been charged "shortfall" fees for not meeting the volume it agreed upon in the SPA contract. So Maersk asked for relief from a costly dilemma that only compounded the problem of not moving as much cargo amid the global economic crisis.
The SPA proposed two solutions: reducing Maersk's space and taking back some of the purchased equipment, or moving the carrier's operations at the Wando Welch Terminal in Mount Pleasant to a "common-use area" in the yard, where non-union SPA employees would handle its cargo.
The carrier pursued the second option.
"They've chosen a course for long-term success in Charleston," SPA spokesman Byron Miller said Friday. "That would provide a new 10-year contract with the SPA. That would allow Maersk to remain and grow in Charleston."
Miller stressed the need for resolution "for the benefit of our port and our state and the local economy." He said today's economic situation requires flexibility.
Riley has noted previously that union man-hours are down at least 10 percent for the year.
"We'd rather have the jobs," he said Friday.
Riley added that Maersk might promise a new contract and continue to bring cargo through the port, but that today's economic climate also means "there are no guarantees."
If the company switches to the common-use area, 30 clerks, 16 maintenance workers and six or seven longshoremen could be left without jobs, Riley said. Maersk accounts for more than 3,400 man-hours on the waterfront each week, according to Maersk officials.
While the carrier uses that fact as bargaining tool, those man-hours underscore why union labor cannot concede, said John Alvanos, president of Local 1771 Clerks and Checkers.
"If Maersk were to go common user, we lose those jobs. Losing those jobs, we lose benefits. Losing those benefits, we lose health insurance," he said.
Riley said Maersk always has the opportunity, when volume goes down, to hire fewer union workers.
"They have been a great customer to us," he said. "We have been a great labor force to them."
Riley returned Thursday from a discussions with Maersk officials in Houston and said he "left there disheartened." He led the emergency meeting with local union members that night.
