USS struggles to survive
EMBATTLED US Shipping Partners has today delayed its quarterly results and warned that it faces potential dissolution.
“Due to continued liquidity constraints, there remains substantial doubt about the partnership’s ability to repay its indebtedness and in such circumstances, to continue as a going concern,” USS said in a regulatory filing.
The Jones Act barge and tanker operator said it was delaying quarterly results because it requires more time to determine how market conditions impair its integrated tug barge fleet valuation. The ITBs are currently valued at $103.2M, but the company conceded that a write-down is likely and would translate into an impairment charge of $66M-$77M.
USS also offered a bleak outlook on its joint venture with Blackstone to construct nine product tankers at NASSCO.
USS revealed that “in light of the partnership’s financial condition and current market conditions, it is unlikely that the partnership will recover its equity investment in the joint venture”.
USS was kicked off the New York Stock Exchange last week after falling below the minimum market cap requirement. Its common units

Previous Story DHEC wrapping up Kinder Morgan permit, published 09/30/08 After a three-year review and hours spent addressing the concerns of worried local residents, state health officials gave the final nod to Kinder Morgan Energy Partners' request to dramatically increase the amount of coal that passes through Charleston.
State regulators announced the permit's approval Friday afternoon. It allows the Texas-based energy company to more than double the volume of coal transported through the Cooper River terminal en route to power plants throughout the Southeast. Although coal demand is high, company officials say it's unclear when they'll expand because of the weakened market.
Throughout the company's lengthy application process, nearby residents and boaters who dock at the neighboring Cooper River Marina had raised concerns about coal dust pollution. But their worries weren't grounds for a denial, explained Liz Basil, a permit director for the S.C. Department of Health and Environmental Control's Bureau of Air Quality.
"We have to go with the science and the law, and the law states that if a facility can demonstrate compliance with state and federal air regulations, we must issue the permits," she said. "We can't issue based on whether or not a community approved or disapproved of the project."
DHEC regulators added conditions to the permit than the company applied for. For example, the original permit said that crane operators had to stop scooping coal from ships onto conveyer belts when the sustained wind speed hit 35 mph — a threshold that was lowered to 25 mph in the final permit.
In addition to tougher requirements, company officials voluntarily have spent $1.5 million on improvements that meant to cut down on coal dust and reduce train crossing times.
Those efforts impressed Park Circle resident Kristen French, who participated in a monthly, company-sponsored forum. Still, she plans to stay vigilant as the company expands.
"I do feel like we have to stay active because Kinder Morgan as a larger corporation doesn't have a good track record even though the people in Charleston have been good about cooperating," she said Friday.
Paul Hensarling, who said he often has to wash coal off his 30-foot-long sailboat at the marina, said he was disappointed to learn that the company will be allowed to expand its coal capacity.
"It's one of the things where, if they increase it, at one point it'll become unbearable to the people who have boats there, and they'll move to a different marina," he said.
DHEC officials have conducted tests to see if the air at the marina is safe to breathe. The testing showed that the dust level doesn't violate federal health standards, but other tests did confirm that the biggest component of the dust at the marina is coal.
The agency said it will continue to monitor the level of coal dust that reaches the terminal, though that doesn't give Hensarling much peace.
It's unclear how soon the company could begin constructing a second docking terminal and prepare for an additional coal pile inland from the river — improvements needed to handle the extra coal.
Arthur Rudolph, the company's regional general manager, said he's excited to get the permit but that he didn't know when the company would begin expanding.
"With the market changing the way it has, we don't know. A lot of the things that have affected the global market have affected the coal market," he said, noting he'd have to check with utility companies that they supply to gauge their interest.
Though demand for coal is at record highs, rising fuel costs have made it more expensive to ship coal from South America to U.S. utility plants as the facility had proposed to do. Also, increasing demand from China and India has pushed up international coal costs, making domestic coal a better buy.
The expansion would add 45 jobs to the facility's current roster of 85 workers, Rudolph said.
