Court says league’s port terminal challenge too late

The Coastal Conservation League missed out on its right to challenge
permits for a new port terminal and access road because it did not file
its appeal with the state in time, an appeals court said Thursday.



The state appeals court upheld a previous ruling from the Administrative
Law Court, saying that the league’s argument that it did not know about
the permits was not a valid excuse. The court said the environmental
group failed to take necessary steps to ensure it would receive
notification from the S.C. Department of Health and Environmental
Control, the state’s permitting agency.



The league’s attorney, Blan Holman, said he plans to seek a rehearing
from the appeals court. If that court will not take the case, Holman said
the league will seek review by the state Supreme Court.



“We respectfully disagree with the Court of Appeals decision,” said
Holman, an attorney with the Southern Environmental Law Center.



The DHEC board heard the league’s original challenge to the DHEC staff’s
permitting decisions and affirmed the permits with only minor revisions.



It was that decision that the league was looking to challenge in the
courts, but an administrative law judge dismissed the case on the grounds
that the league did not file its appeal in time.



State law requires any entity challenging a DHEC ruling to do so within
15 days of the date the department mails permit notices. The league
argued that it should have been on the notification list because its
representatives had sent numerous letters and attended all hearings on
the matter.



The Coastal Conservation League also is pursuing a challenge in federal
court against the Army Corps of Engineers, saying the permits it issued
for the terminal and access road were based on faulty studies that
underestimated traffic-related impacts, among other things.



Despite the legal tangles, the SPA is continuing with construction of its
planned $600 million, three-berth terminal on the former Navy base in
North Charleston. The Legislature has already signed off on $182 million
in taxpayer funds to build the port access road that would connect the
terminal to Interstate 26.



“Port expansion is vital to the long-term economic health of the
Charleston area and the entire state of South Carolina,” SPA Chief
Executive Bernard Groseclose said. “It’s essential that we press on with
this project.”
