State ports in Wilmington and Morehead City won't shut down completely, but no new vessels would be loaded or unloaded if longshoremen strike in the coming weeks.
The International Longshoremen's Association, which represents workers who load and unload vessels at both ports, is locked in an ongoing labor dispute with the U.S. Maritime Alliance, which represents shippers.
The two groups are expected to resume talks Monday under the direction of the Federal Mediation and Conciliation Service to try to reach a compromise before the current labor contract expires Sept. 30.
N.C. State Ports Authority officials are watching closely because if an agreement isn't reached in time, a longshoremen's strike is possible at East Coast and Gulf ports beginning in October.
"During a strike, what you won't see occurring is the loading and unloading of vessels," said Jeff Strader, Ports Authority deputy executive director and chief financial officer.
Each week, an average of four to seven ships call on the Port of Wilmington and three to five vessels call the Port of Morehead City. But Strader said port business wouldn't grind to a halt.
"There are many other things that the port does relative to receiving cargo, dispatching cargo, handling and storing and things of that nature," he said. "Those activities would continue."
The impact of a strike on the state ports, Strader said, would largely depend on its duration and whether it affected all ILA operations or only certain work, such as the loading and unloading of container
ships. A short strike, he said, would likely have little or no impact on the authority's bottom line for the long-term.
"It's a disruption in the chain that just has to be absorbed," Strader said.
Strader added that this is an unfamiliar scenario for N.C. ports, as there hasn't been a strike on the East Coast since 1977.
Strader said the Ports Authority is not a party to the negotiations.
"Our stance on this is neutral," he said.
Strader said where shipments destined for the state ports would go during a strike depends on where the cargo originates and its ultimate destination. Some shipping lines, he said many have options to divert
cargo to the West Coast or Canada, while others may not.
"For example, if it's a transatlantic service that utilizes a stevedore who uses ILA labor for vessel-side activities, they'll have to ride it out," he said. "So it's really going to depend."
Key issues in the labor dispute include overtime rules and royalty payments to longshoremen based on container weight.
The U.S. Maritime Alliance says union members are taking advantage of loose overtime rules and driving up shipping costs. The longshoremen's union says a small minority are being singled out to unfairly characterize
the whole membership.
Meanwhile, retailers and trucking companies are also watching closely, and some retailers have already begun re-routing ships in anticipation of a possible strike as the holiday season approaches. The National
Retail Federation recently urged the two parties to return to the negotiating table.
"Failure to reach agreement will lead to supply chain disruptions which could seriously harm the U.S. economy," Matthew Shay, federation president and chief executive officer, said in a recent letter.
Shay said lack of a contract could drive shippers away from East and Gulf Coast ports in the same way that a 2002 West Coast ports lockout caused shipping to shift in their favor.
"Having a secure, long-term longshore labor contract in place is critical to ensure that the East and Gulf Coast ports continue to benefit from growing labor volumes," he said. "Without such certainty, retailers
and others will surely reevaluate their supply chains and the short-term and long-term reliance on these ports."
Strader said the N.C. ports are hopeful that the ILA and shippers will work out their differences.
"That's our fondest hope.… A strike is the last thing anyone wants to do," he said.
